On August 17, 2012, the Securities and Exchange Commission ("SEC") filed a Complaint in United States District Court, Western District of North Carolina, Charlotte Division, against Rex Venture Group, LLC ("Rex Venture") d/b/a ZeekRewards.com ("ZeekRewards"), and Paul R. Burks. The SEC alleges that Rex Venture and and Burks fraudulently offered and sold securities in an unregistered offering as part of a combined Ponzi and pyramid scheme. On August 17, 2012, Judge Graham C. Mullen issued an Order appointing Kenneth D. Bell of McGuireWoods LLP as temporary receiver (“Receiver”) for Rex Venture Group, LLC d/b/a ZeekRewards.com. The August 17th order directs the Receiver to, among other things, take control and possession of and to operate the Receivership Estate, and to perform all acts necessary to conserve, hold, manage and preserve the value of the Receivership Estate. At this time there is no claims process and no distribution. The Receiver is currently gathering ZeekRewards investment history and harmed investor information from the Defendants in an effort to facilitate the claims process and subsequent distribution to harmed investors. UPDATED 4:06 P.M. EDT (U.S.A.) It happened after the collapse of AdSurfDaily in 2008 — and it’s happening now in the aftermath of the collapse of Zeek Rewards amid spectacular allegations by the SEC Friday of Ponzi and pyramid fraud.
The office of North Carolina Attorney General Roy Cooper issued a warning minutes ago about “reload scams” aimed at taking advantage of Zeek victims.
Here is the warning in its entirety (italics added):
Reload scams hit consumers when they’re down, offering to help them make back money they lost to a previous scam or bad business decision. These scams have been popular for years with telemarketing fraud rings but can also follow other types of fraud.
We’re now seeing reload scams seeking to recruit consumers who were members of Zeekler, a penny auction website headquartered in North Carolina that shut its doors last week and entered into a settlement with the U.S. Securities and Exchange Commission. The SEC determined that Zeekler was a Ponzi scheme, using money from later investors to pay back earlier investors until the scheme started running out of money. The Attorney General’s Office is continuing to investigate Zeekler.
Blogs, news releases online, and individuals leaving comments in articles about the Zeekler shut down are already touting opportunities “for those that are looking for something that can help them replace the income they were receiving from Zeek Rewards.” If you’ve been a part of a scheme such as Zeekler that collapsed, or if you lost money to another recent scam, don’t fall for a reload scam. Better to cut your losses than lose even more.
The exact phrase quoted by Cooper’s office in the paragraph above appears in a news release for something called TheMayDayReport.
The SEC called Zeek a $600 million Ponzi- and pyramid scheme that had affected more than 1 million investors. Cooper’s office opened a probe into Zeek in July, and the U.S. Secret Service also is investigating Zeek.
Over the weekend, the PP Blog received multiple spams aimed at Zeek threads. Purportedly from “Briant,” those spams promoted a “program” called Ultimate Power Profits. Like Zeek, Ultimate Power Profits has a presence on well-known Ponzi scheme forums such as MoneyMakerGroup.
Zeek’s former head cheerleader at MoneyMakerGroup — “mmgcjm” — also is the head cheerleader for Ultimate Power Profits at the forum.
On Friday — the same day of the Zeek collapse — an MLM “program” known as Vi-Tel Wireless (Vi-Tel) issued a news release to announce it was sponsoring a “Zeek Rescue Program.” Affiliates busied themselves heralding the purported rescue program across the web.
Vi-Tel called itself a “safe refuge.” Vi-Tel affiliates aimed sales pitches at websites carrying information on Zeek, leading to questions about whether reps were circling like vultures. It was remarkably awful PR.
In other post-Zeek news, an auction “program” known as Bidify now is offine. The company says it is trying to retool itself in the aftermath of the Zeek collapse.
Like Zeek prior to the collapse, Bidify denies it is an investment program.
Zeek, Rex Venture Group LLC and operator Paul Burks were charged Friday with selling unregistered securities as investment contracts.

U.S. District Court Appoints Kenneth D. Bell as Temporary Receiver Over Rex Venture Group, LLC d/b/a ZeekRewards.com
CHARLOTTE--(BUSINESS WIRE)--The following statement is being issued to announce the appointment of Kenneth D. Bell as temporary receiver over Rex Venture Group, LLC d/b/a ZeekRewards.com.
Authority of Receiver
On August 17, 2012, Judge Graham C. Mullen of the U.S. District Court for the Western District of North Carolina, Charlotte Division, entered an order appointing Kenneth D. Bell of McGuireWoods LLP as temporary receiver of ZeekRewards for the purposes of marshaling and preserving all assets of ZeekRewards and those assets (a) held or possessed by ZeekRewards; (b) held in constructive trust for ZeekRewards; and (c) fraudulently transferred by ZeekRewards.
The Court’s Order gives the Receiver all powers, authorities, rights and privileges that were possessed by ZeekRewards and its officers, directors, members, managers and general and limited partners.
The Receiver assumes and controls the operation of ZeekRewards and, among other things, uses reasonable efforts to determine the nature, location and value of all property interests of ZeekRewards, of whatever kind, which ZeekRewards owns, possesses, has a beneficial interest in, or controls directly or indirectly. The Receiver will work diligently and efficiently to obtain receivership property and then maintain control and custody of the property.
The Order appointing the Receiver was issued in connection with a lawsuit by the Securities and Exchange Commission alleging that ZeekRewards and its principal, Paul Burks, offered and sold unregistered securities in a combined Ponzi and pyramid scheme. It is alleged that, since approximately January 2011, ZeekRewards and Burks raised more than $600 million from approximately 1 million investors nationwide and overseas by making unregistered offers and sales of securities through the ZeekRewards website in the form of Premium Subscriptions and VIP Bids.
Receivership Process
The Receiver is systematically obtaining control over the Receivership assets and records (1) by placing affected persons and the public on notice of the Complaint and the Order appointing a temporary receiver, and (2) by physically securing the place of business.
Receiverships generally involve putting into place people and procedures to preserve assets and to analyze the claims against the assets. After completing that, such receiver would file a motion with the court with a recommendation as to treatment of the assets and claimants. The proposal would generally be made available to all affected persons. Such persons would be given an opportunity to object to the proposal and any
continuing objections would be determined by the court. Finally, the assets and claimants would be treated as the Court would determine after reviewing the receiver’s recommendations and any objections to them. Reports will be filed with the Court periodically and major reports will be posted on the Receivership’s website.

A: No, Paul Burks, the owner, agreed to settle without admitting wrongdoing and agreed to cooperate with a court-appointed receiver, so the government is in control and I do not believe the government will run the Zeek penny auction….
Q: I invested in ZeekRewards, how do I get my money back and how fast?
A: The USA court will appoint a receiver, it will be a long procedure, months if not years. The contact details of the receiver are not published yet, check this website for an update. If you have invested in the last 30 days and you paid with a credit card you maybe can claim it back through your credit card company.
Q: I have not taken any money out of my ZeekRewards account, will I get it?
A: Unknown at this point. I can imagine the late investors will be paid first, so people who invested in the last weeks. $5 million a day came in July, the receiver will not have enough money to pay all back.
Q: How much money is available for refunds?
A: About $225 million in 15 foreign and domestic financial institutions, minus government / administration costs.

A: No, in a scam you put your money in and the majority will never get a penny, up to closing ZeekRewards paid it's affiliates up to $375 million. Zeek had only 8 complaints in the week they were closed, which is on 1 million affiliates very low. The SEC calls it a Ponzi did not use the word "Scam", however it is an academical discussion.

A: The SEC did not play it hard on Paul Burks, only $4 million penalty….. It would be possible in the SEC's opinion he never intended to build up a Ponzi, penny auction compensation plans are complicated. He operated in a gray area and choose the wrong compensation plan and made the wrong decisions.

$7 million, out of $600 million revenue, Paul Burks has withdrawn approximately $11 million minus $4 million penalty. Paul Burks also paid $1 million to family members.

Paul Burks has a home in Lexington, USA. He is not arrested or in jail, part of the SEC deal is he agreed to cooperate with a court-appointed receiver.

A: Of course people will tell you "Told You So" but 1 million people were involved, and a lot of very experienced leaders did not see this disaster coming also. Nothing to be ashamed for in my opinion; bad luck, wrong decision.

A: No, I do not like penny auctions and running www.businessforhome.org is already a full time activity. I report facts and figures which is something else then whether or not a Direct Selling company is legit.

Q: What do you think about other penny auctions or can you advice me an other opportunity?
Penny auctions do have a credibility problem through this situation, as so many people are hurt. My advice is, as allways, to do your own due diligence. If you want little or no risk choose for a 5+ year old (public traded) company, like Nu-Skin, Herbalife, Avon, USANA, Amway ect.
If you can handle risk (No Guts, No Glory) take a startup, there are thousands. I am not endorsing any Direct Selling companythrough this website.
